Profile

Rosa is a Bar Scholar. After graduating with First Class Honours from the University of Hong Kong, she obtained a Distinction in the BCL from the University of Oxford, ranking 1st in her year in Advanced Property and Trusts, and Comparative Public Law. She also obtained a Distinction in the PCLL, ranking 1st in her year in Civil and Criminal Litigation, and Matrimonial Practice and Procedure. She joined Chambers in 2018.

Rosa has developed an active practice in both civil and criminal law. She is an experienced advocate in her own right, and has represented owners of prestigious commercial premises including The CenterPrince’s BuildingThe One and Silvercord, as well as operators of iconic casinos including Marina Bay SandsMGM and Venetian.

She has been led as a junior in notable cases, including the criminal trial and appeal of ex-government official Fung Wing Yip, Wilson (馮永業), the China Shanshui litigation, the Convoy Global litigation, the Fok Family feud and the lawsuit between singer G.E.M. (鄧紫棋) and her ex-manager.

She also acts for the Department of Justice as fiat counsel, as well as statutory public bodies such as Mandatory Provident Fund Authority.

She has regularly appeared in arbitrations, both as a sole advocate and as a led junior.

Rosa was a part-time lecturer of law in Equity and Trusts, and Legal Research and Writing at the University of Hong Kong.

  • Robert Von Palace Kolbatschenko and Another v Lee Io Vai Ivan and Another [2020] 6 HKLRD 444 (acted for the beneficiaries of a trust in continuing a Mareva injunction, led by Mr. Chua Guan-Hock SC)
  • Lai Dominic Yuk Tsun v Hanwood Enterprises Ltd and Another [2021] HKCFI 1249 (acted for the respondent in dismissing an appeal against a specific discovery order, as sole advocate)
  • Great Silver Investments Ltd v Sky Trend Global Ltd and Another [2020] HKCFI 2987 (obtained a variation of a Mareva injunction, as sole advocate)

  • Re Lee Ming Cheung [2020] HKCFI 297; [2020] 2 HKLRD 76 (acted for a beneficiary of a trust in resisting a stay of bankruptcy petition application, as sole advocate)
  • Re China All Access (Holdings) Limited [2021] HKCFI 1842 (successfully obtained a winding-up order against a multi-layer BVI company, as sole advocate)
  • Re ACE International (B.V.I.) Limited [2021] HKCFI 1273 (acted for the shareholders of a BVI company in dismissing a petition with indemnity costs, as sole advocate)
  • LMC v MKP [2019] HKCFI 2619 (resisted the setting aside of a statutory demand, as sole advocate)

  • To Lee Wah Samuel v Yum Huin Ming and Anor [2019] HKCFI 1441 (succeeding in a trial for upholding the validity of two enduring powers of attorney, with Mr. Terrence Tai); [2019] HKCFI 2304 (obtaining indemnity costs against the plaintiff, with Mr. Terrence Tai)
  • Ng Yung Mei To suing by her next friend Ng Yuk Chuen Lomia v Ng To Kwan HCA 1086/2019 (opposed the continuation of an ex parte injunction on grounds of material non-disclosure in relation to Part II proceedings, as sole advocate)

Arbitration:

  • Defended a prominent mobile advertising company in a 10-day arbitration in respect of a multi-million RMB commercial dispute (led by Mr. William Wong SC, JP with Mr. Martin Kok)
  • Acted for a Hong Kong company in a dispute involving the exercise of share option rights and obtained final award (as sole advocate)
  • Acted for a leading cosmetic brand in a 6-day arbitration in respect of a distributorship dispute (with Mr. Justin Lam)
  • Advised on the availability of emergency relief in an arbitration involving a foreign partnership dispute (led by Mr. William Wong SC, JP)

Criminal Law:

  • HKSAR v Fung Wing Yip, Wilson [2019] HKDC 1113, [2009] HKDC 1304 (on appeal to the CFA) (defended the accused who was an ex-government official on charges of corruption and misconduct in public office, led by Mr. Joseph Tse SC)
  • HKSAR v Tang Wing Tung STCC 951/2019 (defended the accused on one charge of conspiracy to defraud in a 3-day trial, as sole advocate); [2020] HKCFI 3054 (conviction quashed on appeal)
  • HKSAR v Lee Pui-shan [2021] HKDC 825 (defended the accused on one charge of misconduct in public office and alternative charge of fraud, led by Mr. Joseph Tse SC)
  • HKSAR v Chan Dick-sze [2021] HKCFI 3875 (defended the appellant on one charge of dangerous driving causing death, led by Mr. Joseph Tse SC)
  • As fiat counsel for the Department of Justice in the prosecution of cases

Employment:

  • Garden Medical Centre Limited v Chan Chiu Lung Richie HCA 1129/2019 (acting for a medical surgeon in an employment dispute, as sole advocate)
  • Advising on employment issues concerning the construction of restraint of trade clauses and incentive entitlements (as sole counsel)

Other Advisory Work:

  • Advised on the applicability of listing rules in relation to conflict of interests and connected/major transactions in a Singapore arbitration (led by Mr. William Wong SC, JP)
  • Advised on and drafted submissions to the HKEx on the suitability of directors of a listed company under the listing rules (led by Mr. Johnny Mok SC, BBS, JP)
  • Advised a major media distribution company in Hong Kong on intellectual property law and contract law issues (as sole counsel)
