Hong Kong’s competition law marks its 10th anniversary this year, a milestone that continues to shape the landscape for businesses.
On 6 November, The British Chamber of Commerce in Hong Kong and Freshfields co-hosted their annual competition law seminar. DVC member Catrina Lam SC joined the distinguished panel, following a keynote address delivered by the Competition Commission’s CEO, Rasul Butt (畢仲明). The discussion, moderated by Ninette Dodoo (Partner, Freshfields), brought together leading practitioners including Lester Lee (Executive Director, (Legal Services), Competition Commission), Dennis Beling (Managing Director, BRG) and Tim Mak (Partner, Freshfields).
Catrina shared her perspectives on:
- Key enforcement trends over the past decade
- The extent to which the Competition Tribunal rely on precedents from other jurisdictions
- The implications of forthcoming judgments on cases concerning textbook sales, abuse of substantial market power, and resaleprice maintenance
- The increasing role of arbitration in competition disputes, and
- The case for introducing standalone private actions to strengthen Hong Kong’s enforcement framework
The seminar provided a timely reflection on how competition law continues to evolve and its practical impact on business strategy in Hong Kong.
