As part of the Des Voeux Chambers Oxford-HKU Visiting Fellowship Programme, we are honored to host Professor William Swadling (University of Oxford) for an upcoming DVC Legal Series Special exploring the question: “What is a Remedial Constructive Trust?” Our member Mr. Tom Ng will be the moderator.
The lecture will examine the fundamental distinction between institutional and remedial constructive trusts by addressing the opaque terminology surrounding both concepts. It will analyze how these trusts operate in practice, evaluate five distinct legal perspectives on remedial constructive trusts, and contrast the divergent approaches across English, Australian, and Hong Kong jurisprudence.
