On 2 April 2019, the Supreme People’s Court and the Department of Justice of the Government of the Hong Kong Special Administrative Region (“HKSAR”) signed the Arrangement on Mutual Assistance in Interim Interim Enforcement by Arbitration between the Mainland and Hong Kong (“Arbitration Preservation Arrangement”), which is the first time that the Mainland has signed a document with other jurisdictions to provide interim assistance in arbitral proceedings. It is also the seventh judicial assistance arrangement signed between the mainland and Hong Kong, which is of great significance for ensuring the effective enforcement of arbitral awards. Since then, Mainland and Hong Kong have signed a series of judicial assistance arrangements and meeting minutes in the field of arbitration, providing a direct, effective and convenient way for the convergence of civil and commercial laws and judicial rules in the Guangdong-Hong Kong-Macao Greater Bay Area (“GBA”).
Jointly organised by the Department of Justice (“DoJ”), the South China International Arbitration Centre (Hong Kong) (“SCIA-HK”) and the Shenzhen Court of International Arbitration (“SCIA”), a seminar on“Recent Development and Implementation of the Arrangement Concerning Mutual Assistance in Court-ordered Interim Measures in Aid of Arbitral Proceedings by the Courts of the Mainland and of the HKSAR” is scheduled on 14 Oct 2022 (Friday) from 15:30-17:40 with a networking session to follow.
As one of the DoJ’s annual events to share the latest development in the Arbitration Preservation Arrangement, the event will be held in a hybrid format (Putonghua with simultaneous online interpretation in English) with online streaming of the offline seminar taking place at SCIA-HK’s office in Two IFC.
DVC member Sabrina Ho, was invited to attend as a speaker, along with experts from DoJ, the Research Office of the Supreme People’s Court and front-line legal practitioners from Hong Kong and Mainalnd, to share the first-hand experience in exploring the implementation of the Arrangement, and discuss the innovation and practice of judicial assistance and cross-border dispute resolution services in the GBA.
