A Book Talk with Dr Min Kyung Kim: Overriding Mandatory Rules in International Commercial Disputes

Des Voeux Chambers, in collaboration with AAIL, recently hosted a thought-provoking Book Talk featuring Dr. Min Kyung Kim, an independent neutral at Des Voeux Chambers and author of the newly published Overriding Mandatory Rules in International Commercial Disputes (Hart Publishing, 2025).

The event began with insightful welcome remarks from Dr. Anthony Neoh SC JP, Co-Chairman of AAIL. During the book talk, Dr. Kim examined the limitations on party autonomy imposed by Overriding Mandatory Rules (OMR) and provided a comparative analysis across jurisdictions such as Korea, the EU, England, Germany, and Switzerland in the context of cross-border litigation and arbitration. The session was moderated by Justice Anselmo Reyes, International Judge at the Singapore International Commercial Court.

A lively Q&A session followed, where participants engaged in a rich discussion about the interaction between OMR, common law, and international law, as well as the challenges of balancing legal certainty with the protection of public interest.
