At the Hong Kong Summit on Commercial Dispute Resolution in China jointly organised by Beijing Arbitration Commission/Beijing International Arbitration Center, HKIAC and Ciarb (East Asia Branch) on Saturday, 14 October 2023, Winnie Tam SC joined a panel on “Intellectual Property Protection in China: The Premier and Balanced Momentum” as Commentator.
Winnie shared an interesting case on application for registration of a trade mark for services in China. She also discussed the Exposure Draft of the Anti-Unfair Competition Law in China, which brings the law up to date to regulate private rights in the digital economy. She drew attention to a pioneering set of Interim Measures published in the PRC in August 2023 to regulate Generative AI developers and platforms providing generative AI to the public. These interim measures impose obligations on developers on ensuring legitimacy of training data, and forbids platforms from unauthorised farming and retention of personal data.
The panel was moderated by Victor Dawes SC, Chairman of the Hong Kong Bar Association. Guanbin XIE, Director of Lifang & Partners and Durward Kan, Vice-President of the Legal Department of China Resources (Holdings) Company Limited also joined as speaker and commentor.
