4th Edition SHIAC Academy: Chinese Enterprises in Cross-Border Arbitration and Insights from Hong Kong Law took place in Shanghai

Co-hosted by SHIAC, Shanghai International Arbitration (Hong Kong) Center, Fangda Partners, and Des Voeux Chambers, the event featured case studies, mock cross-examinations, and panel discussions from DVC members, attracting around 100 legal and corporate professionals with practical insights.

  • Welcoming Remarks: Mr. Yi Ma, Vice Chairman of CCPIT Shanghai and SHIAC, and Mr. Nuo Ji, President of the Shanghai Bankruptcy Administrators Association and Partner at Fangda Partners, commenced the event by underscoring the significance of advancing cross-border legal dialogue and collaboration.
  • Case Sharing: William Wong SC used real-world cases to highlight the key challenges encountered by Chinese enterprises in Hong Kong, including disputes over corporate control, problems with trust structures, and managing arbitration alongside litigation, and offering practical guidance to attendees.
  • First Panel Discussion: Adrian Lai, together with Mr. Xiongchao Chen (Fangda Partners), Mr. Ronghua Shen (SGLA Law Firm), and Ms. Jiji Wu (Hui Zhong Law Firm), discussed common challenges faced by Chinese lawyers in Hong Kong-seated arbitrations and practical solutions.
  • Interactive Mock Cross-Examinations showcased key witness questioning techniques in international arbitration: Ms. Suosheng Xu (SHIAC) acted as arbitrator; John Hui representing the respondent and Joshua Yeung representing the applicant. Ms. Yun’er Wang (Fangda Partners) and Ms. Yiran Li (Fangda Partners) acted as the factual and expert witnesses.
  • Second Panel Discussion: Michael Lok and Charlie Liu, joined by Mr. Jun Gao (Zhong Lun Law Firm), Mr. Di Mou (Llinks Law Offices), and Ms. Zhu Peng (Fangda Partners), offered a comprehensive overview of how procedures like discovery and witness testimony in international arbitration are applied in Chinese Mainland practice.
  • Closing Remarks: Ms. Yang Guang, Deputy Secretary-General of SHIAC, concluded the event with an emphasis on strengthening collaboration between Hong Kong and Shanghai.
